This contribution focuses on Les Intérêts présens des puissances de l'Europe (1733), a two-volume work published to serve as a practical alternative to the 8 volumes in-f° of the Corps Universel. Rousset discusses treaty obligations undertaken by sovereign entities, and links them up with an analysis of their long-term geopolitical interests. I sketch the impact of the Peace Treaties of Utrecht (1713) on Rousset's work, and argue that his treatment of the matter gives a unique insight into argumentative strategies. Parties in a quarrel use arguments drawn from the law of nature, Roman law, canon law, customary law, feudal law or domestic law, and only seldom refer to law of nations doctrine. Rousset's synthesis at the end of every section is representative of diplomatic practice in his time. Treaties contained political compromises. In order to be effective, they needed precedence over domestic norms. We study the genesis of the triad "army - gendarmerie - civic guard" and its evolution in the Belle Époque. The present contribution focuses on the epithet ‘rebel’ or ‘pirate’ in the complex negotiations on the amendment and confirmation of the European peace order established at the end of the War of the Spanish Succession (1701/1702-1713/1715). Delving into British and French diplomatic correspondence, successive examples of ‘rebels’ or ‘pirates’ come to the fore, from Brittany over Scotland, Catalunya, the Jacobites and Neapolitan privateers, to arrested Spanish and Swedish diplomats. Les hallebariders sous demeurés pêlemême avec les assistans hors de l'enceinte. </p><p>f. 309r°</p><p>Les archers sont appelés la garde-noble, & pour entrer dans un corps, il falloit autrefois etre noble, ou du moins avoir servi dans les troupes en qualité d'officier.</p><p>Madame la <b>mareschale Dhaun,</b> & la jeune comtesse sa belle fille, etoient placées dans la gallerie d'en haut & plusieurs dames de qualité, comme la <b>Princesse de la Tour </b>& autres, s'y sont aussi trouvées.</p><p>Dans la seconde gallerie etoient les trompettes & les timbales, qui ont commencé à jouer dabor [sic] que le gouverneur general est entré dans la salle.</p><p>La 3e gallerie d'en bas etoit occupée par les <b>Dames du commun</b>.</p><p>L'assemblée ainsi composée, le <b>comte d'Elissem</b> - <b>doien du Conseil d'Etat</b>, s'est avancé vers les Deputés auxquels il a fait une petite harangue sur le sujet de leur convocation. Ensuite le grand audiancier a commancé par lire tout haut & assis l'acte de l'Empereur qui donnoit plein pouvoir & authorisoit le mareschal <b>Dhaun pour assembler les Etats & leur faire connaître ses volontés à ce sujet-là.</b></p><p>Aprés cela il a continué par lire un autre papier ecrit en<b> langue bourguignone [</b>sic]. Car c'est ainsi que l'on appelle la langue françoise dans les <b>archives du païs.</b> Cet <b>acte que toutes les provinces avoient deja reçus chacune en particulier</b>, contenoit la disposition que l'Empereur feroit de tous ses Etats & païs hereditaires, en faveur des Princesses ses filles au defaut d'enfans mâles, ensorte que lesdits païs devoient passer à l'ainée desdites Princesses, & en cas de même defaut du côté de cette Princesse, il apelle au méme heritage la cadette & de suite ses soeurs & enfin ses nieces filles du <b>feu Emp[ereu]r. Ce qui etant fait, l'on a joué une musique de la Trompette & des timbales, & dans le même tems un heraut d'armes s'est avancé vers les Deputés & leur a dit: Messeieurs, son Exce vous prie à table.</p><p>L'assemblée a fini de la sorte, & le Gouverneur s'est retiré de la même maniére qu'il etoit venu au son des Trompettes & des Timballes.</p><p>Il n'y a eu au dîner que les Deputés des Etats. Il y avoit seulement 74. couverts. La table a eté servie abondamment & delicatement à deux fois 130. plats & 18. relevés. L'on a <b>bû copieusement les santés de l'Empereur, de l'Imperatrice, de l'archiduchesse</b> &a à chacune desquelles on repondoit par le son des trompettes & des timballes placées sur une gallerie qui donne dans le parc.</p><p>Le Buffet etoit composé de tout ce qu'il y avoit de curieux, puisque les principaux de la noblesse y avoient envoié ce qu'ils avoient de plus beau.</p><p>Il y a eu un <b>dessert magnifique</b> de 147. couverts d'office & trés proprement servi en toutes sortes de confitures & de sucrerie trés bien travaillées avec les devises & representant toutes sortes de figures, d'oiseaux, d'abrisseaux &a. La piece du milieu, un <b>aigle de sucre </b>posé sur une grosse boule tenant une couronne qu'il sembloit presenter à l'archiduchesse aussi representée. L'ouvrage etoit orné de<b> piliers, de galleries, de balustrades</b> &a. Le tout etoit de sucre.</p><p>A la fin du repas tout le dessert fut donné <b>au pillage à la foule des assistan</b>s & à la <b>populace</b>.</p><p>L'on avoit suspendu au milieu de la table un arbre d'argent <a href="https://www.littre.org/definition/artistement">artistement</a> fait, composé de plusieurs branches & orné d'un trés <b>bel email bleu</b>. De hertog van Brabant en zijn onderdanen bij Goswin de Wynants [24ste Belgisch-Nederlandse Rechtshistorische Dagen] (Leuven: KU Leuven, 30 MAR 2023)<p style="text-align: center;"></p><div class="separator" style="clear: both; text-align: center;"><a href="https://pbs.twimg.com/media/Fsh6uaeWAAAewMH?format=jpg&name=small" imageanchor="1" style="margin-left: 1em; margin-right: 1em;"><img border="0" data-original-height="503" data-original-width="671" height="240" src="https://pbs.twimg.com/media/Fsh6uaeWAAAewMH?format=jpg&name=small" width="320" /></a></div><br /><p></p><p style="text-align: left;">De Leuvense collega's van de OE Romeins Recht en Rechtsgeschiedenis organiseerden de 24ste Belgisch-Nederlandse Rechtshistorische Dagen. Ik had het genoegen er een lezing te mogen geven.</p><p>Abstract:</p><p></p><blockquote>Burggraaf Goswin Arnold de Wynants (1661-1732) geniet enige discrete bekendheid als alumnus van de Leuvense rechtenfaculteit, advocaat en raadsheer bij de Raad van Brabant te Brussel en topadviseur van Keizer Karel VI (1685-1740) in Wenen en Praag bij de Hoge Raad voor de Nederlanden. Zijn illustere schoonzoon Patrice-François de Neny (1716-1784) is de auteur van het standaardwerk Mémoires historiques et politiques sur les Pays-Bas autrichiens. Wynants wijdde zelf twee intrigerende manuscripten aan de instellingen van de Oostenrijkse Nederlanden (1730) en de fiscale constitutie van het hertogdom Brabant (1723). Beide onuitgegeven werken (Conscience-erfgoedbibliotheek Antwerpen; KBR) werden gedigitaliseerd en met de Pylaia HTR-technologie (Transkribus) geanalyseerd. De stellingen van deze dienaar van het centrale gezag werden eerder als regalistisch (en impliciet jansenistisch) gekarakteriseerd: Wynants houdt een restrictieve interpretatie van belastingvrijstellingen aan, verzet zich tegen ambtsverkoop en kijkt kritisch naar het discours van adel, clerus en ambachten. Binnen- en buitenlandse doctrine (Van Espen, Choppin, Le Bret, Christyn, Anselmo, Stockmans, Tuldenus …), middeleeuwse charters, vroegmoderne ordonnanties en uiteraard de rechtspraak van de (soevereine) Raad van Brabant (waarvan Wynants’ rechtspraakverzameling postuum werd gepubliceerd in 1744) kruiden een heldere en informele schrijfstijl. Gezien het belang van de Brabantse traditie in de vertogen van zowel de Brabantse Omwenteling (1787, 1789-1790) als de Belgische revolutie (1830-1831) is de constitutionele theorie van Wynants bijzonder boeiend. Hij verdedigt met hand en tand het verbod om belastingen te heffen zonder instemming van de staten. In zijn ogen gaat het om een natuurrechtelijk en oorspronkelijk recht, en geenszins om een (positiefrechtelijk en dus herroepbaar) privilege. Vorst (in Brabant: hertog, ongeacht andere titels) en onderdanen zijn aan elkaar gebonden in een wederkerige relatie. Recognition can be seen as a purely political decision, decided by the executive branch under supervision of the legislature. However, the terms of the debate between the ruling Liberal party and the Catholic opposition make clear that both the law of nations and constitutional history were used as arguments. Belgian constitutional history, and especially the revolution of 1830, had provided legitimating concepts sustained by both political parties. The recognition of Piemontese annexations was decried as a violation of Belgium’s permanent neutrality, and a potential precedent undermining the position of ‘secondary nationalities’. It is doubtful whether legal motives, rather than economic interests, played a decisive role in the outcome of the debate.
